Kinkeade had ordered Healey to appear o be deposed as part of a lawsuit by ExxonMobile against the attorney general in response to Healey's investigation into whether the oil company misled consumers with its research on climate change. Healey has fought that order, and it was unclear whether she intended to comply until all alternatives had been exhausted. Healey had been seeking a stay of Kinkeade's order until the 5th Circuit Court of Appeals could rule on her appeal, but Kinkeade on Friday denied the stay. Prior to Kinkeade's latest order cancelling the deposition, Healey's office on Monday morning said they were still waiting on the 5th Circuit to consider their separate motion for a temporary injunction until the full appeal could be heard.
